Terms of Service
1. Acceptance of Terms
By accessing or using the Octopus Hire website at octopushire.ai or platform at app.octopushire.ai (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. About Octopus Hire
Octopus Hire is a B2B SaaS platform that provides hiring intelligence to companies, including CV verification, candidate trajectory prediction, dynamic scoring across the hiring cycle, behavioral integrity analysis, and constructive rejection feedback.
Octopus Hire is currently in early stage and in the process of incorporation. These Terms will be updated to reflect the registered entity and its registered office once incorporation is complete.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal authority to bind the company you represent
- Provide accurate and complete information
- Not be barred from receiving services under applicable law
4. Account Terms
You are responsible for maintaining the security of your account credentials. You must promptly notify us of any unauthorized access. You are responsible for all activity that occurs under your account.
You may not share your account credentials with third parties or create accounts on behalf of others without authorization.
5. Pilot Program Terms
Octopus Hire currently offers two pilot tracks:
Standard Pilot (Path 1). A free trial period during which you can evaluate the Service. After the pilot, you may choose to continue to a paid plan once we launch commercially, or end your engagement. You may request deletion of your data after the pilot, or remain on our waitlist for future product updates. Standard pilot data may be used by Octopus Hire to improve the Service in aggregated and anonymized form.
Partner Pilot (Path 2). A more committed engagement in which you agree, prior to entering the partner pilot, to enter into a paid contract of at least one year upon Octopus Hire's commercial launch. Partner pilots receive early access to advanced features, including hiring intelligence and patterns tailored specifically to your company that begin compounding from the start of the pilot.
In exchange for these tailored capabilities, partner pilots agree to share hire performance data with Octopus Hire. This information is used in two ways: (a) to refine and tailor the intelligence provided specifically for your company, which remains private to your company and is never shared with any third party, and (b) in aggregated and anonymized form, to inform broader regional hiring intelligence that benefits the wider Octopus Hire ecosystem. Aggregated regional intelligence does not contain identifiable information about your company, your candidates, or your employees.
The specific terms of the partner pilot, including data sharing, performance reporting cadence, and commercial commitments, will be detailed in a separate written agreement signed prior to onboarding.
6. Customer Obligations Regarding Candidate Data
When you use the Service to process candidate data (such as CVs, assessment results, interview notes, and other candidate information), you represent and warrant that:
- You have a lawful basis under applicable data protection law to collect, use, and share candidate data with Octopus Hire
- You have provided candidates with appropriate notice of how their data will be processed
- You will comply with applicable data protection laws in your jurisdiction
- You will not upload data that is unlawful, misleading, or that you do not have rights to share
You are the data controller for candidate data. Octopus Hire is the data processor and will process candidate data only on your instructions.
7. Acceptable Use
You may not:
- Use the Service in violation of any law
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service to harass, defraud, or harm others
- Upload viruses, malware, or any other harmful code
- Use the Service to violate the privacy or rights of any individual
- Scrape, copy, or systematically extract data from the Service
- Resell or redistribute the Service without our written permission
8. Intellectual Property
Octopus Hire and all associated trademarks, logos, software, algorithms (including the VERA and AURORA engines), designs, and content are the exclusive property of Octopus Hire and protected by intellectual property laws.
You retain ownership of the content and data you upload to the Service. By using the Service, you grant Octopus Hire a limited license to process your data solely to provide the Service to you, in accordance with our Privacy Policy and any applicable pilot terms.
You may not use the Octopus Hire name, logos, or branding without our prior written permission.
9. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available." During the pilot phase, we provide the Service with reasonable effort but make no warranties regarding uptime, accuracy, or fitness for a particular purpose.
To the maximum extent permitted by law:
- Octopus Hire is not liable for any indirect, incidental, special, or consequential damages
- Our total aggregate liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) one hundred US dollars ($100)
The Service makes recommendations and predictions about candidates based on data and algorithms. Final hiring decisions are made by you. Octopus Hire is not responsible for the outcome of any hiring decision made by you or your company.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or applicable law.
You may stop using the Service at any time. For paid services, termination terms will be specified in your service agreement.
Upon termination, your right to use the Service ends. Provisions regarding intellectual property, liability, and dispute resolution will survive termination.
11. Modifications to the Service and Terms
We may modify the Service at any time. We may update these Terms periodically. Significant changes will be communicated via email to registered users or through a notice on the website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction of Octopus Hire's registered office, to be confirmed upon incorporation.
Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation. If negotiation fails, disputes will be resolved through arbitration or in the competent courts of the jurisdiction of Octopus Hire's registered office.
